Terms of Service

1. Acceptance of Terms

By accessing or using Rat Radar ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Rat Radar provides access to public data about rodent sightings and restaurant health inspections in the Greater Boston area. The Service includes both free and premium subscription tiers. All data is sourced from publicly available government records.

3. Account Registration

To access certain features, including Rat Premium, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. We reserve the right to refuse service or terminate accounts at our discretion.

4. Subscription and Payment Terms

4.1 Rat Premium Subscription

Rat Premium is offered as an annual subscription for $19/year. By purchasing a subscription, you agree to pay all fees associated with your subscription.

4.2 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method.

4.3 No Refunds

All sales are final. We do not offer refunds for Rat Premium subscriptions. You may cancel your subscription at any time to prevent future charges, but no refunds will be issued for partial subscription periods or unused time.

4.4 Subscription Renewal and Cancellation

Subscriptions automatically renew annually unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

4.5 Price Changes

We reserve the right to change subscription prices. Price changes will apply to new subscribers immediately and to existing subscribers upon their next renewal. We will provide notice of price changes in advance.

5. Prohibited Uses

You agree not to use the Service to:

• Scrape or harvest data: Use automated tools, bots, scrapers, or crawlers to extract data from the Service
• Resell or redistribute data: Sell, license, sublicense, or otherwise commercialize data obtained from the Service
• Create derivative products: Use our data to build competing products or services
• Abuse the system: Make excessive API requests, attempt to bypass rate limits, or overload our infrastructure
• Circumvent access controls: Attempt to access premium features without a valid subscription
• Reverse engineer: Decompile, disassemble, or reverse engineer any part of the Service
• Violate laws: Use the Service for any illegal purpose or in violation of any applicable laws
• Harass or harm: Harass, abuse, or harm other users or our staff
• Impersonate: Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Interfere with service: Interfere with or disrupt the Service or servers connected to the Service

6. Intellectual Property Rights

6.1 Service Content

The Service, including its design, layout, code, and original content, is owned by Rat Radar and protected by copyright, trademark, and other intellectual property laws. The underlying government data is public domain, but our presentation, aggregation, and analysis is proprietary.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include the right to:

• Collect or use data systematically
• Create derivative databases or products
• Redistribute data to third parties
• Use the Service for commercial purposes without our written permission

7. Data Accuracy and Disclaimers

7.1 Data Sources

All data displayed on the Service is obtained from publicly available government sources, including official 311 service request systems and health department records from cities and towns in the Greater Boston area. We do our best to display this data accurately, but we make no warranties about the completeness, accuracy, or timeliness of the data.

7.2 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of data
• Uninterrupted or error-free operation
• Security or freedom from viruses

7.3 No Professional Advice

The Service provides information only and does not constitute professional health, safety, or legal advice. Do not rely solely on this Service for health or safety decisions. Always consult appropriate professionals and official sources.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAT RADAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any data obtained from the Service
• Unauthorized access, use, or alteration of your data or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Rat Radar, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or transmit through the Service

10. Account Termination

10.1 Termination by You

You may terminate your account at any time by contacting us at support@ratradar.com. Termination does not entitle you to a refund.

10.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment of fees
• Any reason at our sole discretion

We may pursue legal action for violations of these Terms, including seeking damages and injunctive relief.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Third-Party Links and Services

The Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party services is at your own risk and subject to their terms and policies.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Massachusetts. You consent to the exclusive jurisdiction of these courts.

13.3 Waiver of Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rat Radar regarding the Service and supersede all prior agreements.
